The legal limit of 0.08 blood alcohol content as measured by a breath device, urinalysis or blood test is in effect in the state of Arkansas, but Zero Tolerance BAC level is .02 percent, which means if the arresting officer detects the smell of alcohol and you are under 21 years old, you will be arrested for driving under the influence. If, for example, you were pulled over for DUI suspicion and your BAC level is .18 percent + other violations such as overspeeding, refusal to take chemical test, traffic accident, having minors in your car or have prior convictions, under the enhanced penalty law, you will be penalized twice than the usual fine.

The State of Arkansas also observes the Implied Consent Law but on your first offense, your license will be suspended for 4 months (120 days); 2 years for your 2nd offense and 2 years and 6 months for the 3rd time around.

You will serve mandatory jail time on your 3rd offense and must enroll yourself for alcohol education and assessment/treatment. If there is a court order for an installation of ignition interlock device, you will take care of its expenses. There is also a possibility for vehicle confiscation after the 4th offense. However, you can still receive some consideration through hardship license while your license is suspended, given you can justify the reasons why there is a need so.

Penalties may vary due to other factors such as death, injury or if a child was endangered. So if you have been arrested for DUI in Arkansas, you need to call us and ask for an Arkansas DUI Attorney to represent you in court. Arkansas DUI lawyers will help you lessen the damages and spare you from future troubles.
