District of Columbia DUI Law observes the "per se" BAC level of 0.08 percent, which means you are not allowed to drive if the alcohol concentration in your blood is .08 and above. You will also get arrested if you are below 21 years old and intoxicated since DC state observes the Zero Tolerance Law. The arresting officer will issue an Order of Proposed Suspension, which requires your presence at the Superior Court and the Department of Motor Vehicles Permit Hearing Office. You must (request for a) schedule of hearing within 10 days if you are a DC-resident; 15 calendar days if you are from a different state. Your driving privileges will be in "pending" status during the waiting period (between your notice and date of hearing). If the result is in your favor, your privileges will be fully restored. If not, you can appeal for a Limited Occupational License but you need to meet the requirements first. 

 

Your first DUI offense in District of Columbia is considered as a misdemeanor charge. You need to spend time in jail for up to 90 days, depending on the courts discretion. Minimum fine is $300 to $1,000, depending on the circumstances of your case. If your license is suspended (revoked), you will need to schedule a hearing with the DMV, as mentioned earlier. You will need to present documents to prove financial responsibility (DC SR22 insurance) and pay $98 reinstatement fee for your license. 

 

On your second DUI conviction, your jail sentence could be up to 1 year based on previous convictions and circumstances. Fine ranges from $1,000 to $5,000 and license suspension for 1 year with mandatory alcohol education from the court. 

 

Third offense means $10,000 amount of fine, 2 years license suspension, 1 year in jail and mandatory alcohol education, according to DC DUI Law.
