Georgia DUI Attorney
What are the consequences of driving under the influence in the state of Georgia? The legal BAC limit for all states is 0.08 percent. It is illegal to drive if you have alcohol in your bloodstream above that level. If you are under the age of 21, you may face tougher drunk driving restrictions. The Zero Tolerance BAC level in Georgia is 0.02 percent, while 0.15 percent for Enhanced Penalties. Implied Consent Law is observed so you cannot refuse to submit yourself for a sobriety test.
However, in Georgia, you may either be charged with “less safe” violation or “per se” violation. The “per se” violation are the ones stated above. The "less-safe" driver dui laws can convict you if your BAC level is 0.05 percent or less. Arrests are sometimes based on the police officers discretion: suspicious behavior (anger, combativeness, etc.), reckless driving, disobeying traffic signals, driving in the wrong direction, having a bloodshot or glassy eyes, broken headlights, expired licenses, caught talking on the cellphone while driving and/or misleading the officer.
License will be suspended for one year on your first offense, but you can still apply for a provisional license with limited privileges. You also need to comply if there is a court order for installation of interlock device on your ignition. You will be responsible for the cost of the installation and maintenance of the device.
You also need to complete a mandatory alcohol education and assessment and/or treatment. After your fourth offense in DUI in Georgia, your vehicle will be confiscated.
If in any case you were pulled and the officer saw open container (canned beer) in your car, even if you are not intoxicated and the beer belongs to someone else in the car, you will be scrutinized for DUI. This is due to the existing Open Container Law that prohibits the possession and drinking alcohol inside a vehicle or in public places.
In times like these, you need a Georgia DUI Attorney to handle the issue for you. DUI is a crime and if you were not guided properly, a DUI charge against you will damage your career and your future.
