    In Guam, refusal for a BAC test carries administrative penalty. If you have no prior dui conviction, your license will be suspended for 6 months only, while 2 years if there are prior convictions.  

     

    In Guam, the following sanctions may only be ordered by the court: 

     

    • Fines: 

    - 1st offense = $1,000–$5,000 

    - 2nd offense = $2,000–$5,000 

    - 3rd offense = $3,000–$5,000 

     

    • Incarceration: 

    - 1st offense = 48 hours 

    - 2nd offense within 5 years = 7 days 

    - 3rd offense within 5 years = 90 days 

     

    The penalties for driving on a suspended license as a result of a DUI conviction include a fine 

    not to exceed $1,000, the possibility of jail time not to exceed 1 year, and an extension of the suspension period for the same time period as the original suspension.
