The State of Kentucky is operating under the Per Se BAC (Blood Alcohol Concentration) Level of 0.08 percent and 0.02 percent for Zero Tolerance (Note: All 50 states now have laws that make it illegal for persons under age 21 to drive with any amount of alcohol in their system.) So if you are under 21 and the authorities detects the smell of alcohol in your breath, your BAC level will be tested and arrested for DUI if you have a BAC of 0.02 percent.
If you got involved in a traffic accident and your BAC is 0.18 percent, you will be charge with drunk driving under the influence even if there are no injuries or death. DUI with minors in your car is also enough for you to get charged.
If you refused to take a test during your arrest, Kentucky authorities will suspend your license for 30 days. 1 year for the second time around and 2 years on your 3rd offense. You will be spending some time in jail and must complete a mandatory alcohol education. If the authorities found out that you are an alcohol dependent, you need to undergo treatment to reduce your drunk driving convictions.
The court might also order for an interlock device on your vehicle and you will be responsible for its installation and maintenance. Worst case scenario: possible vehicle confiscation and you cannot apply for hardship license while your license is suspended.
