Louisiana DUI Attorney

LRS 32:661 or Louisiana Drunk Driving Law operates under the Per Se BAC level of 0.08 percent, zero tolerance of 0.02 and enhanced penalty of 0.15. Implied Law is in effect, which means drivers must submit themselves to a chemical test -- breath, blood or urine testing -- if they are suspected of DUI. Refusal will lead to license suspension and other penalties.

Now, if you are really adamant to take a test, DMV (Louisiana Department of Motor Vehicles) will suspend your license for 90 days. It can lead up to 1 to 2 years on your 2nd and 3rd offense respectively. You can still apply though for a hardship license after 30 days. There is no mandatory alcohol education for DUI offenders in Louisiana but you need to undergo mandatory assessment or treatment if the result of your evaluation tells you that you are alcohol dependent.

After your second offense, you need to install an ignition interlock device and pay for its maintenance should Louisiana court ordered for it. Open Container Law is in effect, for both drivers and passengers.
