Montana DUI Attorney

Planning for a road trip in Montana? I am sure you know the basics: gas, brakes, tires, oil, water, pack of sandwiches, med kit, etc. But little did you know that in Montana, you should always carry a Montana DUI Attorneys calling card with you in case you got pulled by highway patrols in Montana suspecting you for driving under the influence.

DUI is a criminal offense in the U.S. and most states authorities show no consideration for offenders. So you need to know your rights and responsibilities in case you were being suspected for drunk driving and only a Montana DUI attorney can help you out.

Here are the basics about Montana DUI Law (MCA Title 61, Ch. 8, Part 4):

- Montana observes the .08 BAC Per Se Law (according to the National Highway Traffic Safety Administration, .08% alcohol concentration in the bloodstream of a driver, even experienced drinkers, show impairment in driving ability)

- Zero Tolerance BAC is 0.02%

- Enhanced Penalty BAC is 0.18%

- Implied Law is in effect (Note: Most states now have passed laws that require vehicle drivers to submit to a chemical test if they are suspected of DUI. Implied consent laws carry penalties such as mandatory suspension of license if the driver refuses for a test)

Failure to comply with the test will result for license suspension. Six (6) months on your first offense; 1 year on your second and third conviction with mandatory jail time after your second offense.

In order to reduce your Montana DUI conviction(s), you need to complete a mandatory alcohol education and treatment, should the authorities found out that you are an alcohol dependent.

It is already too bad that Montana do not allow dui offenders to apply for a provisional license while their license is suspended. Just imagine if there is anything worse than the implimentation of Open Container Law, which is applicable for both driver and passengers. You are heading into serious trouble if you do not have a Montana DUI Attorney to represent you properly. Call us now before worse comes to worst.
