So just like any state, New York DUI Law observes the Per Se BAC Level of .08% as the limit for a driver to get charged with DUI. 0.08% and above of alcohol concentration in your blood spells trouble already. If you are 21 years old and below, driving with only .02% BAC, that spells trouble too. High alcohol concentration in the body, even if you consider yourself an expert driver (and drinker!), can cause driving impairment. In the event of a traffic accident, or traffic violation such as overspeeding and New York authorities found your BAC higher than .18%, you will be subjected for penalty enhancement.  

 

As mentioned earlier, the arms of New York DUI Law is not that "cruel" to dui offenders. Unlike in New Jersey, for example, on your 3rd dui conviction your license will be suspended for 10 years. In New York, 6 months only (2nd and 3rd offense) without mandatory incarceration.  

 

You can also plead for a provisional license in case you need to drive for work. But like I said, there is no reason to be happy that you are within New York when the authorities apprehend you for drunk driving.
