Tennessee DUI Attorney
It is against the law for any person to drive a motor vehicle in the state of Tennessee while under the influence of alcohol (or drugs) with BAC level of .08% or higher. In Tennesse, it is not necessary for arresting officers to notice signs of intoxication from you; your high BAC level is enough to give you away. Be reminded though that even if your BAC is lower than the legal limit but you are showing some signs of inconsistencies in front of Tennessee police, you can still get arrested for DUI.
So what will the Tennessee officers will do to you after they asked you to pull over for DUI suspicion? Prior to initiating the DUI stop, the officer is already establishing the case against you by observing your driving patterns. You will be asked to perform a field sobriety test and chemical test to check your blood alcohol concentration. You will be informed by the officer of the repercussions in case you refused to take the test. If you are still adamant the second time he asked you to take the test, your license will be revoked for a year. And that is only for refusing to take the exam.
For your second dui conviction in the state of Tennessee, you will be facing a 2-year license suspension. If there was an accident involved and someone died during the accident, your license will be revoked for 5 years. You will be spending mandatory jail time for 45 days to 11 months and 29 days.
Tennessee court will also ask you to pay a fine amount between $600 to $3,500 plus other court associated costs. You will be required to pay restitution as well to damaged properties and/or injuries from the accident.
Also on your second dui conviction in Tennessee, the court may order for the installation of an interlock device at your expense. There is also a possibility for vehicle confiscation, depending on your prior conviction and existing dui case. Expect the worst on your third conviction.
To make sure you can get out alive (and unscathed) of this mess, call a Tennessee DUI Attorney to represent you properly in court and help you minimize the damage (fines, penalties, etc.) Only a good Tennessee DUI Attorney can really help you and we have the best Tennessee DUI Attorneys in the country today so give us a call now.
